Mitsubishi Electric Appeals European Commission's Revised Decision Regarding Gas Insulated Switchgear Case

Tokyo, September 13, 2012 - Mitsubishi Electric Corporation (TOKYO: 6503) announced today that on September 12 it filed an appeal with the European General Court against a decision issued on June 27 by the European Commission to recalculate fines in an ongoing case before the European Court of Justice regarding alleged infringement of EU competition law in respect of sales of gas insulated switchgear (GIS) products.
Mitsubishi Electric will present its arguments at court.

The Commission's revised decision set a fine to be imposed solely on Mitsubishi Electric at 74,817,000 euros, and another fine to be borne jointly with Toshiba Corporation at 4,650,000 euros.

Background

In January 2007, the European Commission imposed a fine for an alleged infringement of EU competition law regarding GIS sales in Europe by several manufacturers, including Mitsubishi Electric. Mitsubishi Electric's fine was set at 113,925,000 euros, and a separate fine shared with Toshiba Corporation was set at 4,650,000 euros. Mitsubishi Electric appealed to the European General Court in April 2007.

On July 12, 2011, the European General Court annulled the fine against Mitsubishi Electric after finding that the Commission had demonstrated unequal treatment of various parties in the case when setting fines. The Court upheld, however, the Commission's finding that EU competition law had been infringed. Mitsubishi Electric appealed the infringement finding to the Court of Justice of the European Union on September 22, 2011, and this appeal remains ongoing.
